The Harry Potter Lexicon trial transcript

by Wendy on May 2nd, 2008

If you’re looking for some light reading (yeah, right!) for the weekend, why not try the complete transcript of the JK Rowling trial. It actually makes for some very interesting reading; JK Rowling makes a good case for herself, but I’m still not entirely convinced that the Harry Potter Lexicon should not be published. How about you?

OMG, wendy dear, how can you still not be sure? if the twit maybe asked for Jo’s permission to publish, that would be an entirely different argument. i think the only reason this guy did this was to actually meat Jo in person.

now keep in mind, the man’s brillant and his website is like, insane, but still. stupid move on his part.

I’m not convinced it shouldn’t be published either. If Rowling didn’t want any other books written about the world she created, she should have stopped them all. But she hasn’t.

When an author creates characters and worlds with their words and it is published, they are entitled to copyright protection through their publisher. The other books written about JK’s magical world are analytical and explorative of the genre and subject matter. They quote from the series but remain largely the author’s analysis and discussion. Vander Ark’s publisher is looking to print a book consisting of more than 80% of JK’s words. There is very little of Vander Ark or his contributors original input proposed. Yes, he intended to give credit but in essence he’s basically doing an index of the series and wanting to be published ( a basic English literature writing assignment). If he had just set up a link on the website - after contacting JK - we might never have heard of this case. In the literary world an author’s work is their own. It belongs to them with all that entails. As a writer takes on a project that uses other authors works, they must also be careful to maintain the clear lines of what is their own thoughts versus the original author. There is a fine line and unfortunately, Steve/his publishers crossed it.
